Recently Ericka found out that Able Quevedo did get out of jail. The DA's office can't seem to give us any information about anything. It is difficult to just give up, but we have had to accept that this whole thing is out of our control. The witnesses have not been cooperative. We feel that they have been threatened, so they are afraid. They just need to understand that they may not be safe whether they testify or not. They are all in jail, and the defendant is walking free. Ericka found a picture of the defendant on his my space page, with his face covered in tatoos. He has doomed himself to a life of crime because he will never be able to get a job out in society looking the way that he does. Some day there will be justice I believe.

We just found out yesterday that the person who killed Ryan did not get out of jail two weeks ago. Thanks to Ericka for not stopping, she found out that there is another hold on him. The Assistant DA would not give her any information, only to say that he never got out of jail. So we can hope that he will go back to prison for something else. As long as he is not free to walk since Ryan never will again. Ericka thanks for still digging for information. You will never know how much we love you.

The case against the person who killed Ryan was dropped on Monday. The witness did not show up, so the judge put out a warrant for his arrest. That doesn't make much sense, because the DA said he would not let it go to court. So I am not sure what they will do with the witness since there will be no trial. The defendant walked free on Tuesday. We are just having to work at accepting what we can not change. Maybe there will be justice somewhere down the line. That is our only hope for now.

Well we have been told that the case is going to be dropped because of lack of evidence. Monday the Assistant DA is going to go before the judge and ask for more time, but we won't get our hopes up. They have told us that if they don't get more time on Monday, the defendant will walk free that day. This whole thing has been the most frustrating thing to go through. It will almost be unbearable thing to hear that he is going free. We do not intend to go watch it. The Asst. DA said he would call us on Monday to let us know what happens.

Things are not any better today. The Assistant DA called last night and said the DA and the appellate board are not going to let them take the case to trial and he led us to believe that the defendant had agreed to accept the plea bargain, but the appellate board would not let them offer it to them. This morning another Assistant DA explained that the defendant wanted probation but would not admit to being guilty of murder because he would have to tell the judge how he killed Ryan. So things have changed a little since last night. They tell they are still going to Fort Worth to day to interview another witness, and the third witness is being brought in from east Texas. So we don't really understand that if they have already told us that the appellate board and the DA are not letting this go to court.

We are pretty discouraged today. Last night the assistant DA called and said that they are taking the case to the DA today to see if he even wants to take it to trial. They say that the only witness is too shaky. So within the next few days the defendant will probably walk free. The most frustrating thing is that there is absolutely nothing that we can do.

Just found out this morning that the DA's office issued a warrant for the arrest of another witness that is in prison in Tennessee, and he is on his way back today. They are questioning a witness who is in jail in Ft. Worth, he was suppossed to be Ryan's friend, but now he is in more trouble and will not cooperate as a witness unless they bargain with him. Will hear from the Da's office this afternoon, they were to question the defendent this morning and they had him in court this morning with his attorney.

Well it has been a very difficult day in court. We really don't know much more now than we did yesterday. The witness finally showed up an hour late and quite obviously beaten up and claimed that the defendant sent one of his guys to threaten him. The DA's office says they have a very weak case right now because the only witness is so shaky. We are going to have to decide whether to offer a plea bargan which we don't believe he will accept, or go on to trial with the weak case. There is a chance that the person who killed Ryan could walk out a free person next week. We are pretty discouraged right now and feel quite beaten up emotionally. We feel we will be in trial next week. If so jury selection begins monday, Oct. 5th, for which we have been told to not come to. So we will probably be there Tues. Will let everyone know asap.

We are going to pretrial tomorrow, Sept 28th. Things have been bad this past week, the case is either coming together or falling apart. They found the witness, but he has changed his story saying that he was high on drugs and was not present at the murder and doesn't know who did it. It is very discouraging, but we haven't given up. We still hope for the best. If we can get it past the judge and to the jury, the detectives believe they will convict him. So it looks like we are going to court on Oct. 5th, that day they will pick the jury and we go from there.

We have another new trial date this morning, October 5th. They can not find the witness right now. But they have so many charges against the guy who killed Ryan, that he won't be getting out of jail.

July 7, 2009, Just got word from the Assistant DA that the trial has been postponed. Don't have a new date yet. Will have to wait a few weeks to get a new date set.

6/25/2009 We have received word that the detectives have begun to question the witnesses. A mother of a witness called to tell me that the detective had been out to question her son, and said that there was only one other trial that was before ours, and the only thing that would postpone it is if that trial took longer than expected. So maybe we will get this over with soon.
