We are pretty discouraged today. Last night the assistant DA called and said that they are taking the case to the DA today to see if he even wants to take it to trial. They say that the only witness is too shaky. So within the next few days the defendant will probably walk free. The most frustrating thing is that there is absolutely nothing that we can do.

Just found out this morning that the DA's office issued a warrant for the arrest of another witness that is in prison in Tennessee, and he is on his way back today. They are questioning a witness who is in jail in Ft. Worth, he was suppossed to be Ryan's friend, but now he is in more trouble and will not cooperate as a witness unless they bargain with him. Will hear from the Da's office this afternoon, they were to question the defendent this morning and they had him in court this morning with his attorney.

Well it has been a very difficult day in court. We really don't know much more now than we did yesterday. The witness finally showed up an hour late and quite obviously beaten up and claimed that the defendant sent one of his guys to threaten him. The DA's office says they have a very weak case right now because the only witness is so shaky. We are going to have to decide whether to offer a plea bargan which we don't believe he will accept, or go on to trial with the weak case. There is a chance that the person who killed Ryan could walk out a free person next week. We are pretty discouraged right now and feel quite beaten up emotionally. We feel we will be in trial next week. If so jury selection begins monday, Oct. 5th, for which we have been told to not come to. So we will probably be there Tues. Will let everyone know asap.

We are going to pretrial tomorrow, Sept 28th. Things have been bad this past week, the case is either coming together or falling apart. They found the witness, but he has changed his story saying that he was high on drugs and was not present at the murder and doesn't know who did it. It is very discouraging, but we haven't given up. We still hope for the best. If we can get it past the judge and to the jury, the detectives believe they will convict him. So it looks like we are going to court on Oct. 5th, that day they will pick the jury and we go from there.
